Kalybr is a performance and coaching Platform that enables coaches to design, deliver, and manage training programs, and for clients to track progress and results.

Kalybr is based in Egypt but intends to serve all fitness professionals in MENA

You must be at least 18 years old to use Kalybr as a Coach (Interchanged with fitness professional). If you are a coach, you are responsible for ensuring you hold any licenses or certifications required by local law to provide training or coaching services.

To use Kalybr, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify Us immediately of any unauthorized access or breach of security.

We reserve the right to suspend or terminate accounts that violate these Terms or appear to be misused.

1. Information that you provide by filling in forms in the Platform. This includes information provided at the time of registering to use Our paltform, subscribing to Our services or promotions and corresponding with Us or responding to a survey or marketing communication via e-mail or helpline, surfing Our Platform, or participating in another Platform feature. This may include, but is not limited to, information such as your name, address, phone, email address, postal address, national ID card, photograph of you, username and password, bank details, credit card token information or other information. (“Personal Data” or “Personal Information”). You may, however, visit Our Platform anonymously before registering an account.
2. Upon subscribing to Our services, We may ask you to provide Us with additional information about you such as your educational background, occupational status and field, marital status, personal interests, financial and credit information. We may require you to provide documentary evidence as specified by the applicable law, and these may be subject to change from time to time.
3. Information that We collect about you and your device upon using Our App after you grant Us access permissions. Please note that this information cannot and will not be collected without user consent. This includes but is not limited to:
   • device information including type of mobile, unique device identifiers (IMEI or serial number), device operating system and device’s location and time zone.
   • mobile network information.
4. Information regarding details of transactions that you carry out through Our Platform.
5. Unique application numbers. When you install or uninstall a service containing a unique application number or when such a service searches for automatic updates, that number and information about your installation, for example, the type of operating system, may be sent to Us.
6. Like many websites and applications, We use “cookies” to enhance your experience and gather information about visitors and visits to Our App. Please refer to the “Do We use‘ cookies’?” section below for information about cookies and how We use them.

You may use Kalybr only for lawful purposes and in accordance with these Terms.

You agree not to:

• Copy, modify, or reverse-engineer any part of the Platform
• Share or resell your account
• Upload content that is illegal, offensive, or infringes on others’ rights
• Attempt to bypass security or misuse the Platform in any way

1. We do not sell, trade, rent, lease or otherwise transfer your personal information to third parties unless We provide you with advance notice and except as described below.
2. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.
3. We minimize the amount of Personal Information We disclose to what is directly relevant and necessary to accomplish the specified purposes. We may share and disclose any Personal Information with the following recipients:
   1. We may disclose some or all the collected information to any of Our subsidiaries, Our parent company and any of Our parent company’s other subsidiaries and network partners.
   2. We may disclose your Personal Information to the Platform hosting partners and other parties who assist Us in operating Our App, conducting Our business, or servicing you, so long as those parties agree to keep the Personal Information confidential.

We may disclose your Personal Information when We believe that the disclosure is appropriate to comply with the applicable law, enforce Our App policies, or protect Our or others’ rights, property, or safety such as releasing the information to any local or international law enforcement or governmental agencies in order to assist in the detection, prevention and investigation of criminal activities, fraud, or otherwise.
   4. In the event that We sell or buy any business or assets, which include Personal Data held by Us about Our customers is one of the transferred assets We may disclose to the prospective seller or buyer of such business or asset on the condition that such buyer agrees to comply with this Privacy Policy.

We may disclose your Personal Data with third-party service providers under contract with Us that help Us with Our business operations, such as transaction processing, fraud prevention, and marketing. Please note that in such cases We will only share a minimized amount of data about what is directly relevant and necessary to accomplish the specified purposes.

• To provide the services or customer support on Our behalf.

By virtue of your consent under this Privacy Policy, you hereby accept and authorize that these Service Providers have access to your Personal Information as a part of the provision of Our services to you. The reason is to perform the tasks assigned to them on Our behalf. However, they are contractually bound not to disclose or use the information for any other purpose.

Your Personal Information will automatically be deleted from the Service Providers’ devices after your use of the service.

It is possible that the Service Providers may be able to keep your data by any means. We are not responsible for this kind of data storage and not liable for any misuse of your Personal Information by the Service Providers upon completion of the service provided.

We therefore have no responsibility or liability for the content and activities of these linked sites or applications.

KALYBR SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY OF ITS ACTS OR OMISSIONS IN CONNECTION WITH THIS PRIVACY POLICY. IN NO EVENT SHALL KALYBR’S TOTAL LIABILITY TO YOU IN CONNECTION WITH THIS PRIVACY POLICY FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION EXCEED FIVE THOUSAND EGYPTIAN POUNDS (5000 EGP).
